
BAKAI has prevailed in legal proceedings brought against the non-governmental organization Open Dialogue Foundation (ODF) in Brussels. On April 7, the French-speaking Enterprise Court ruled that the allegations against the bank were unfounded and unsupported by evidence.
The case stemmed from publications by ODF in 2023 in which the organization recommended imposing sanctions against BAKAI over alleged involvement in schemes to circumvent Russia-related embargoes. The bank filed suit to defend its business reputation.
The court found that the allegations were serious and targeted in nature, but were not substantiated by sufficient evidence. As a result, ODF is required to remove the disputed materials, publish the full text of the court ruling on its homepage, and cover legal costs.
"We welcome the court's decision, which confirms that the allegations against BAKAI were without merit and upholds the bank's reputation. BAKAI has always maintained strict compliance with international law and remains committed to transparency in all of its operations," the bank stated.
BAKAI emphasized that this ruling carries significance beyond the bank itself - reinforcing confidence in Kyrgyzstan's financial sector as a whole. The bank will continue to uphold its high standards of compliance and openness, and to defend its interests across international jurisdictions.
BAKAI reaffirms its readiness to undergo any independent review or audit aimed at ensuring an objective assessment of the country's financial institutions.
